How to File for Divorce Without a Lawyer

The first step of the process is to ensure you meet the state's residency requirements to file for divorce in Massachusetts.

If the breakdown of the marriage occurred within the state of Massachusetts, then there is no minimum residency requirement, and the divorce action may be filed at any time.  However, if the breakdown of the marriage occurred outside of Massachusetts, then at least one of the spouses must have lived in the state for a minimum of one year prior to filing the divorce action.  [Massachusetts General Law ch. 208 § 4, 6].

 

Any one of the following items will establish residency - a valid Massachusetts driver’s license, ID card, or voter’s registration card.

The divorce action should be filed in:

    1)  the county where the spouses last resided together if either spouse still resides in that county; or

    2)  the county where either spouse currently resides if the first option does not apply.

Massachusetts does not set a minimum in-county residency requirement before a party may file in that particular county.

Grounds for Divorce

A Massachusetts court may grant a divorce on one of the following grounds:

  • Irretrievable breakdown of the marriage.

  • Adultery.

  • Impotency.

  • Desertion for at least one year immediately before filing for divorce.

  • Habitual intoxication from the excessive use of alcohol or drugs.

  • Cruel and abusive treatment.

  • Willful non-support of a spouse.  This requires a spouse to willfully and cruelly refuse to provide reasonable support for the complaining spouse even though the defendant spouse has sufficient ability to provide such support to the complaining spouse.

  • Criminal conviction resulting in a sentence of at least five years in prison.

Child Support

Child support is set based on the state-mandated guidelines.  Using a Massachusetts child support calculator is best for determining the amount of child support to be paid. The child support calculator uses the child support guidelines prescribed by Massachusetts law. Legal custody is determined based on what is in the child's best interest.

Joint Legal Custody is where both parents have the right to participate in making the major decisions affecting the child. 

Sole Legal Custody is where only one parent has the right to make decisions affecting the child.

In Massachusetts, courts generally favor joint legal custody, but not necessarily joint or equal physical custody of a child.

Physical Custody in Massachusetts

Physical custody says who the children will primarily reside with and the other parent will have visitation as discussed below. 

In Massachusetts, the non-custodial parent generally has the same visitation rights regardless of whether sole custody or joint custody is ordered in the divorce decree.  There are exceptions to this general rule of course, such as when there is a history of domestic violence.

Visitation

Visitation can be any schedule agreed upon by both parents and can be changed at any time provided both parents are in agreement. Basically, the parents are in control of visitation provided they both agree to it and it is in the best interest of the child. If the parents cannot reach an agreement on visitation then the court will require the parents to follow a specific schedule that is determined by the court.  The state provides guidelines on visitation and many parents find it easier to just go by the standard guideline visitation schedule. This will be explained in more detail in your divorce papers.

What documents are needed to file for divorce in Massachusetts?

Short Answer:  1) certified copy of marriage certificate, 2) Petition for Divorce, 3) Affidavit of Irretrievable Breakdown, 4) Record of Absolute Divorce, and 5) financial statements from each spouse.
