Grounds for Divorce

In North Dakota, there is one no-fault ground and seven fault-based grounds for divorce.

No fault ground: 

 

Irreconcilable Differences.  This occurs when there is discord or conflict between the spouses that causes a breakdown of the marriage relationship and there is no reasonable expectation of reconciliation.

Fault-based grounds:

  • Adultery.

  • Felony conviction.

  • Intentional desertion.  This ground usually requires desertion for a period of at least one year.

  • Alcohol and/or drug abuse.

  • Extreme cruelty.  This can be physical or mental cruelty.

  • Willful neglect.  This occurs when a spouse unreasonably fails to properly care for the other spouse and their children, if applicable.

  • Incurable insanity.

How to File for Divorce Without a Lawyer

Residency Requirement:  At least one spouse must have lived in the state for 180 days prior to filing for divorce.

[North Dakota Century Code Ch. 14-05-17].

Divorce papers should be filed in the county where the defendant resides.  If the defendant does not reside in the state, then file in the county where the plaintiff currently resides. [North Dakota Century Code Ch. 14-05-17].

Sole Legal Custody is where only one parent has the right to make decisions affecting the child.

In North Dakota, courts generally favor joint legal custody, but not necessarily joint or equal physical custody of a child.

Physical Custody in North Dakota

Physical custody says who the children will primarily reside with and the other parent will have visitation as discussed below. 

In Massachusetts, the non-custodial parent generally has the same visitation rights regardless of whether sole custody or joint custody is ordered in the divorce decree.  There are exceptions to this general rule of course, such as when there is a history of domestic violence.

Visitation

Visitation can be any schedule agreed upon by both parents and can be changed at any time provided both parents are in agreement. Basically, the parents are in control of visitation provided they both agree to it and it is in the best interest of the child. If the parents cannot reach an agreement on visitation then the court will require the parents to follow a specific schedule that is determined by the court.  The state provides guidelines on visitation and many parents find it easier to just go by the standard guideline visitation schedule.
