Residency Requirement: At least one spouse must have lived in the state for 365 days prior to filing for divorce. [Rhode Island Gen. Law §15-5-12].

Grounds for Divorce

A Rhode Island court may grant a divorce based on one of the following grounds:

  • Irreconcilable differences which have caused the irremediable breakdown of the marriage;

  • Adultery;

  • Extreme cruelty;

  • Willful desertion for five (5) years of either of the parties, or for willful desertion for a shorter period of time in the discretion of the court;

  • Continued drunkenness;

  • Habitual, excessive, and intemperate use of opium, morphine, or chloral;

  • Neglect and refusal, for the period of at least one year next before the filing of the petition, on the part of the husband to provide necessaries for the subsistence of his wife, the husband being of sufficient ability; and

  • Any other gross misbehavior and wickedness, in either of the parties, repugnant to and in violation of the marriage covenant.

Child Support

Child support is set based on the state-mandated guidelines.  Using a Rhode Island child support calculator is best for determining the amount of child support to be paid. The child support calculator uses the child support guidelines prescribed by Rhode Island law. [Rhode Island Gen. Law §15-5-16.2]. Physical custody says who the children will primarily reside with and the other parent will have visitation as discussed below.

In Rhode Island, the non-custodial parent generally has the same visitation rights regardless of whether sole custody or joint custody is ordered in the divorce decree.  There are exceptions to this general rule of course, such as when there is a history of domestic violence.

Visitation

Visitation can be any schedule agreed upon by both parents and can be changed at any time provided both parents are in agreement. Basically, the parents are in control of visitation provided they both agree to it and it is in the best interest of the child. If the parents cannot reach an agreement on visitation then the court will require the parents to follow a specific schedule that is determined by the court.  The state provides guidelines on visitation and many parents find it easier to just go by the standard guideline visitation schedule.
