Grounds for Divorce

A Maryland court may grant a divorce on the following grounds:

No-Fault Grounds:

 

12-Month Separation.  The spouses must have lived separate and apart for the 12 months prior to filing for divorce.

 

Mutual Consent.  This requires that there be no minor children born from the marriage, that both spouses agree to the divorce on no-fault grounds and that they reach a written agreement on all the terms of the divorce.

 

Fault-Based Grounds:

 

Adultery.  The faithful spouse must prove that the other spouse was unfaithful and show that the faithful spouse did not condone or forgive the infidelity.

 

Desertion. The desertion must have been deliberate, final and lasted for at least 12 consecutive months.  There can also be no reasonable expectation of reconciliation.

 

Conviction. This requires a criminal conviction resulting in a sentence of at least 36 months and the convicted spouse must have already served 12 months of the sentence.

 

Incurable Insanity. The spouse be confined to a mental institution for at least 36 consecutive months and one of the spouses must be a resident of Maryland for at least 24 months prior to filing for divorce.

 

Cruelty.  There must have been cruel or vicious treatment, usually involving physical abuse, by a spouse towards either the other spouse or a minor child.

How to File for Divorce Without a Lawyer in Maryland

If the breakdown of the marriage occurred in Maryland, then there is no minimum residency requirement.  If the breakdown of the marriage occurred outside of the state, then at least one of the spouses must have lived in the state of Maryland for a minimum of one (1) year prior to filing a divorce action.  [Maryland Family Law Code Ann. § 7-101].  

 

It’s not difficult to prove residency. For example, any one of the following items will establish residency - a valid state driver’s license, ID card, or voter’s registration card.

Like most other states, Maryland has adopted specific child support guidelines that are presumed to be correct and to be in the child's best interest.  In almost every case, child support must be determined using the state's guidelines. In the event that you and your spouse cannot agree on this issue, the court will use the same calculation as the basis for determining the support obligation.  

In Maryland, a child support obligation usually terminates when the child turns 18.  However, if the child is still enrolled in secondary school at the age of 18, then the support obligation will be extended until the child graduates from high school or turns 19, whichever occurs first.  [Maryland Family Code §401].

Legal Custody in Maryland

There are two types of legal custody in Maryland: Joint Custody and Sole Custody. This determines how decisions are made regarding the raising of the child.

Legal custody is determined based exclusively on what is in the child's best interest.

Joint Custody is where both parents have the right to participate in making the major decisions affecting the child. 

Sole Custody is where only one parent has the right to make decisions affecting the child.

In Maryland, courts generally favor joint legal custody, but not necessarily joint physical custody.

Physical Custody in Maryland

Physical custody says who the children will primarily reside with and the other parent will have visitation as discussed below. 

In Maryland, the non-custodial parent has the same visitation rights regardless of whether sole custody or joint custody is ordered in the divorce decree.

Visitation

Under Maryland law, visitation is any schedule agreed upon by both parents and can change any time both parents are in agreement. Basically, the parents are in control of visitation provided they both agree to it. It is only if the parents cannot agree that the state’s standard visitation schedule applies. Though many parents find it easier to just go by the standard visitation schedule provided under Maryland law. This will be explained in more detail in your divorce papers.
